These Terms and Conditions ("Terms") outline the rules and regulations for the use of ReachLocal TX's services. By accessing our website and using our services, we assume you accept these terms and conditions. Do not continue to use ReachLocal TX if you do not agree to take all of the terms and conditions stated on this page.

1. WEBSITE USAGE

1.1 Cookie Usage

The website uses cookies to help personalize your online experience. By accessing ReachLocal TX, you agree to use the required cookies.

1.2 Third-Party Cookies

By accepting required cookies, you also accept third-party cookies, which might be used via third-party provided services (e.g., payment processors, tracking systems).

1.3 Cookie Management

You have the ability to accept or decline optional cookies through your browser settings. However, declining cookies may affect website functionality.

2. INTELLECTUAL PROPERTY RIGHTS

2.1 Ownership

Unless otherwise stated, ReachLocal TX and/or its licensors own the intellectual property rights for all material on ReachLocal TX. All intellectual property rights are reserved.

2.2 Your Content

You retain all rights to your logo, business name, and other content you provide to us. By using our services, you grant us a non-exclusive license to use your content solely for your campaign.

3. SERVICES OVERVIEW

3.1 What We Offer

ReachLocal TX provides EDDM (Every Door Direct Mail) postcard advertising services. We design, print, and mail shared postcard campaigns to 5,000+ households in specified zones.

3.2 Service Scope

Our services include:

  • Shared EDDM postcard campaigns

  • Ad slot placement on postcards

  • Basic design assistance (fee-based option available)

  • QR code and direct link tracking via Dub

  • Performance reporting (40 days after mail date)

  • USPS mailing

4. CAMPAIGN PARTICIPATION

4.1 Minimum Slots Requirement

Campaigns require a minimum of 10 paid slots to proceed to print. If fewer than 10 slots are sold by the deposit deadline specified in your Service Agreement, the campaign will be cancelled.

4.2 Campaign Cancellation

If a campaign is cancelled due to insufficient slots, you may choose:

  • Option A: Refund of deposit (minus PayPal fee)

  • Option B: 10% discount on next campaign

4.3 Category Exclusivity

We guarantee no competing businesses in your category will appear on the same postcard. Category is defined at time of purchase. Once your deposit is received, your category is locked and reserved.

5. PRICING AND PAYMENT

5.1 Pricing

Pricing is as listed on our website at time of purchase. Prices are fixed and non-negotiable.

5.2 Payment Structure

  • Deposit (50%): Due upon contract signing

  • Balance (50%): Due as specified in your Service Agreement

IMPORTANT: Full payment must be received before order is submitted to printer. Once approved and submitted to production, order cannot be cancelled.

5.3 Payment Method

All payments must be made via PayPal to: info@reachlocalTX.com

5.4 PayPal Fees

PayPal charges a transaction fee (approximately 2.9% + $0.30). This fee is your responsibility and is separate from the slot price. PayPal fees are non-refundable by PayPal and therefore cannot be refunded by us.

5.5 Late Payment

If balance payment is not received by the specified deadline in your Service Agreement, your slot will be forfeited and your deposit will be non-refundable.

6. REFUND POLICY

6.1 Campaign Cancellation Refunds

If campaign is cancelled due to insufficient slots (fewer than 10), you may choose:

Option A: Refund (Minus PayPal Fee)

  • Refund amount: Deposit minus PayPal fee

  • Reason: PayPal fees are non-refundable by PayPal

  • Timeline: 5 business days

Option B: 10% Discount on Next Campaign

  • Discount applies to any future campaign

  • Discount does not expire

  • No refund issued

6.2 No Refunds After Approval

Once you approve your design proof, no refunds are available under any circumstances. Your balance payment is due and non-refundable.

6.3 No Refunds for Non-Performance

We make no guarantee regarding response rate, lead generation, or business results. No refunds will be issued based on campaign performance or lack thereof.

6.4 No Refunds for Missed Deadlines

If you miss any deadline specified in your Service Agreement (asset submission, approval, balance payment), no refunds will be issued.

7. DESIGN AND APPROVAL PROCESS

7.1 Design Options

  • Option A: You design your ad (free) - 1 revision included

  • Option B: We design your ad (+$75) - 3 revisions included

7.2 Asset Submission

If you choose Option A, you must submit all ad assets by the deadline specified in your Service Agreement. Assets must meet specifications (300 DPI, CMYK, correct dimensions).

7.3 Design Timeline

All design deadlines are specified in your Service Agreement, including:

  • Asset submission deadline

  • Proof delivery date

  • Approval deadline (48 hours after proof sent)

7.4 Proof Approval

We will send you a design proof for approval. You have 48 hours to approve or request changes.

7.5 Auto-Approval

If you do not respond within 48 hours, your proof is automatically approved and sent to print.

7.6 Final Approval

Once you approve your proof, design is locked and cannot be changed. You waive all rights to further modifications.

7.7 Design Specifications

All ads must meet:

  • Resolution: 300 DPI minimum

  • Color mode: CMYK (not RGB)

  • File format: JPG, PNG, or PDF

  • Margins: 0.25" on all sides

  • Size: As specified for your slot

Canva Users: Export as "PDF - Print" with CMYK checked and Flatten PDF checked. Do NOT use RGB.

8. DEADLINES AND TIMELINES

8.1 Campaign Deadlines

All campaign deadlines are specified in your Service Agreement. These deadlines are firm and non-negotiable.

8.2 Deadline Consequences

Missing any deadline results in forfeiture of your slot and deposit. No exceptions.

8.3 No Extensions

We cannot extend any deadline. Missing a deadline results in forfeiture of your slot and deposit.

8.4 Performance Report Timeline

Performance reports are sent 40 days after mail date as specified in your Service Agreement. Reports show QR code scans and link engagement data via Dub.

9. PRINTING AND MAILING

9.1 Print Quality

We use professional printers and USPS EDDM service. Print quality is subject to printer standards.

9.2 USPS EDDM Service

We use USPS Every Door Direct Mail (EDDM) service. Postcards are delivered to all addresses in specified delivery routes.

9.3 Delivery Timeline

IMPORTANT - PLEASE READ CAREFULLY: USPS does NOT guarantee delivery dates for EDDM mail.

  • Expected delivery window: 5-10 business days after mail date

  • Carriers are only required to take 1 bundle of 100 per day

  • Delivery can take up to 10 days from mail date

  • "In mailbox date" is not a guarantee

  • Actual delivery varies by route and carrier

9.4 No Delivery Guarantee

We guarantee postcards will be mailed on the mail date specified in your Service Agreement. We do NOT guarantee:

  • Delivery to every address

  • Delivery within specific timeframe

  • Postcards will not be damaged in transit

  • Postcards will not be discarded by recipients

9.5 Reprints

If postcards are damaged or lost in transit, reprints are not available. We are not responsible for USPS delivery issues.

10. TIME-SENSITIVE ADVERTISING

10.1 Offer Duration for Time-Sensitive Campaigns

If your campaign includes a time-sensitive offer, event, or deadline:

  • MINIMUM offer duration: 21 days from mail date

  • RECOMMENDED: 30 days from mail date

Why 21 days minimum?

  • Accounts for full delivery window (up to 10 days)

  • Accounts for response time (7-10 days)

  • Gives people time to act

10.2 USPS Delivery Reality

USPS does NOT guarantee delivery dates. We are NOT responsible for missed deadlines due to USPS delivery delays.

11. TRACKING AND REPORTING

11.1 Tracking Methods

  • QR Code: Tracks scans and clicks via Dub (available for Single Slot and larger)

  • Direct Link: Tracks link clicks via Dub (available for all slot sizes)

11.2 Performance Report

We send a performance report 40 days after mail date showing:

  • Total scans/clicks

  • Scan/click rate percentage

  • Geographic distribution

  • Peak scan/click dates

11.3 Report Limitations

Performance reports show engagement only. They do NOT show:

  • Actual phone calls

  • Actual sales

  • Actual leads

  • Website conversions

  • Customer behavior

11.4 No Guarantee of Results

We make no guarantee regarding response rate, lead quality, or business results. Performance report is for informational purposes only.

12. LIABILITY AND DISCLAIMERS

12.1 We Are NOT Responsible For

  • Your business results or lack thereof

  • Response rate or lead generation

  • Quality of leads or customers

  • Your ability to convert leads to sales

  • Market conditions or economic factors

12.2 Our Sole Responsibility

Our sole responsibility is to:

  • Design and print the postcard

  • Mail the postcard via USPS EDDM

  • Provide tracking and reporting via Dub

  • Honor the terms of our agreement

12.3 No Warranties

We make NO warranties, express or implied, regarding the campaign's effectiveness or results.

12.4 Limitation of Liability

Our total liability is limited to the amount you paid for your slot. We are not liable for any indirect, incidental, or consequential damages.

12.5 Third-Party Services

We use third-party services (printer, USPS, Dub). We are not responsible for their performance or failures.

13. INTELLECTUAL PROPERTY

13.1 Your Content

You retain all rights to your logo, business name, and other content you provide.

13.2 Our Content

We retain all rights to our design templates, layouts, and creative work.

13.3 License Grant

By using our services, you grant us a non-exclusive license to use your logo and business information solely for this campaign.

13.4 Testimonials

We may use your business name and campaign results in marketing materials and testimonials, unless you opt out in writing.

14. CONFIDENTIALITY

We keep your business information confidential and do not share it with third parties except as necessary to complete the campaign (printer, USPS, Dub, etc.).

15. USER CONDUCT

You agree not to:

  • Submit illegal, defamatory, or infringing content

  • Attempt to hack or disrupt our systems

  • Engage in fraudulent activity

  • Violate any laws or regulations

16. TERMINATION

16.1 Termination by Us

We may terminate your agreement if you violate these Terms, fail to pay by deadline, or engage in fraudulent activity.

16.2 Termination by You

You may terminate before design approval by forfeiting your deposit. No termination after design approval.

17. DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Texas. Any legal action shall be brought in Liberty County, Texas.

Before pursuing legal action, you agree to attempt informal resolution by contacting us in writing.

Any disputes shall be resolved through binding arbitration in Liberty County, Texas, in accordance with the American Arbitration Association rules.

18. GENERAL PROVISIONS

These Terms constitute the entire agreement between you and ReachLocal TX and supersede all prior negotiations. Your Service Agreement incorporates these Terms by reference.

We may amend these Terms at any time by posting the revised Terms on our website. Your continued use of our services constitutes acceptance of the amended Terms.

19. SERVICE AGREEMENT REFERENCE

19.1 Service Agreement Controls

Your Service Agreement specifies all campaign-specific details including:

  • Campaign name and zone

  • Mail date

  • Slot type and price

  • All deadlines

  • Payment terms

  • Design options

19.2 Conflict Resolution

If there is any conflict between these Terms and your Service Agreement, your Service Agreement controls for campaign-specific items.

ACKNOWLEDGMENT

By using ReachLocal TX's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and your Service Agreement.
